To convict a person of speeding, the prosecution must prove beyond reasonable doubt that:
- You driving
- You were driving a motor vehicle.
- You were driving on a public road, or in a public place.
- You were driving at a speed that exceeded the speed limit for that road.
Points received from speeding will remain on your licence for 4 years, beginning from the date of your speeding offence.

Speeding Fines
The fixed penalty notice (FPN) is a £100 fine. For non-fixed penalty offences, fines can be as much as £1,000 for non-motorway offences, and £2,500 for motorway offences.
Again, the prosecution must prove that an individual drove a motor vehicle on a road at a speed that exceeded the stated limit for that road.
It is important to check whether the speed limit signs were clearly visible on the road to indicate that speed was restricted.
Section 81 – Speed limit signs
Section 81 of the Road Traffic Act states that any road should be considered to have a speed limit of 30mph if there is street lighting, specifically lamps located a maximum of 200 yards apart.
If you receive a speeding NIP (Notice of Intended Prosecution) informing you that you are being prosecuted for a speeding offence and there was no speed limit signs, you must first establish whether a street lighting system is in place on that road.
The Traffic Signs Regulations and General Directions 2016 sets out the requirements for speed limit signs. Road signs must meet the specified criteria and standards for colour, shape, size and visibility. They must be clearly visible at close intervals, and at set distances from any junctions. If these directions are not complied with, then the speed limits are not enforceable.
